Does Every Foreign Worker in Indonesia Require an RPTKA?

No, not every foreign worker in Indonesia requires an RPTKA (Rencana Penggunaan Tenaga Kerja Asing), or Foreign Worker Utilization Plan. Exemptions apply to certain foreign directors, commissioners, shareholders, and workers performing qualifying activities.

Which Foreign Workers Require an RPTKA in Indonesia?

An RPTKA is an employment authorization document approved by Indonesia’s Ministry of Manpower. It specifies the foreign worker’s position, employment period, and work location.

Foreign-owned companies (PT PMA) generally need RPTKA approval before employing foreign professionals, technical specialists, managers, and directors who do not qualify for an exemption.

Employees transferred from overseas headquarters or affiliated companies may also require an RPTKA, regardless of their existing employment relationship abroad.

Which Foreign Workers Are Exempt from RPTKA Requirements?

Foreign Directors, Commissioners, and Shareholders

Foreign directors and commissioners who hold shares meeting the applicable ownership requirements, as well as shareholders who qualify under the relevant investment provisions, may be exempt from RPTKA approval.

Passive foreign shareholders who do not perform work in Indonesia do not ordinarily require an RPTKA. However, shareholders performing operational or managerial duties may require approval if their activities fall outside the applicable exemptions.

Diplomatic and Consular Personnel

Foreign diplomatic and consular personnel working at foreign missions are exempt from RPTKA requirements.

Foreign Workers Performing Certain Temporary Activities

Certain foreign workers may qualify for RPTKA exemptions for specified activities, including emergency production work, vocational activities, technology-based start-ups, business visits, and research. The applicable conditions depend on the activity concerned.

For qualifying technology-based start-up and vocational activities, the RPTKA exemption applies for a maximum of three months. Employers must submit the required foreign worker information to the Ministry of Manpower.

If employment will continue beyond three months, the employer must apply for RPTKA approval no later than two weeks before the exemption period expires.

Do RPTKA-Exempt Foreign Workers Still Need Immigration Authorization?

Yes. Foreign nationals exempt from RPTKA approval must still hold immigration authorization appropriate to their activities and intended duration of stay.

Foreign investors serving as directors or commissioners may qualify for investor-related immigration arrangements, provided they meet the applicable requirements. Foreign employees requiring RPTKA approval generally follow the employment-based immigration process.

Business visit visas may permit activities such as attending meetings, negotiating contracts, and assessing investment opportunities. However, they do not authorize foreign nationals to perform operational work or provide services outside the permitted scope.

What Happens if a Company Employs a Foreign Worker Without a Required RPTKA?

Indonesian employers that employ foreign nationals without mandatory RPTKA approval may face administrative sanctions, including financial penalties.

Other violations of foreign worker employment requirements can result in suspension of the RPTKA approval process or revocation of existing approvals, depending on the applicable provisions.

Separate immigration consequences may arise if the foreign national performs activities inconsistent with their visa or stay permit, including potential deportation.
